Arbitration Rules
Consult the Arbitration Rules – Compromissory clause (see article 3, appendix VI of the ECR). The AFCOT growing interest in “Values of confidentiality, transparency and equity in arbitration” was the centre of attention in the work done by the AFCOT Executive Committee. This renovation has a triple objective: educational, simplicity and clarity. ►Educational, because comprehensible to all. This text explicitly includes the execution and development of arbitration proceedings, thus enabling readers to familiarise themselves with the concepts governing dispute settlement, thus highlighting its application. This reform offers a simplified reading intended for all European Cotton Rules participants and practitioners. It is also aimed at strengthening the arbitration function, and more broadly at promoting observance of the rules. ►Simplicity, conveyed in the wording of the arbitration clause, the text providing details on the implementation of the procedure as well as the rules to be observed. This new wording, very open and modern, makes it possible to determine the outlines of the arbitration. ►Clarity, thanks to simple and direct rules, understandable for all, providing greater assurance for the signatories of the arbitration clause and a general vision of the nature of the arbitration proceedings. |
